To sum up on forms and rightness. No one wants poetry to be like filling out a form, though plenty of poems look dismally like it. The forms were there to be wrestled with mightily, because they silently and emptily, till one filled them up with the thing said, stood for the recalcitrant outside and other that knows nothing of the human will. The mindless rigidity in principle of the verse patterns suggestively compounded with the sinewy nature of the speaking (...) voice that flowed in continuous energy through the marked-off graph of foot and line and strophe. Together they might be taken to stand for two powers of the mind that ought to work with and against one another to the same effect: the streamy nature of association, said Coleridge, that thinking curbs and rudders. Ezra Pound's commandment to the poet, to compose in the sequence of the musical phrase, not in the sequence of the metronome, is a good warning against monotonous cadences; but taken literally it invites the reply that Beethoven did both. For art is a place where you make choices, sometimes difficult ones that require you decide not between good and bad but between this good and that: very often it is between the beauty of a line and the sense of the whole thing. In this volume of essays, Howard Wettstein explores the foundations of religious commitment. His orientation is broadly naturalistic, but not in the mode of reductionism or eliminativism. This collection explores questions of broad religious interest, but does so through a focus on the author's religious tradition, Judaism. Among the issues explored are the nature and role of awe, ritual, doctrine, religious experience; the distinction between belief and faith; problems of evil and suffering with special attention to the Book of (...) Job and to the Akedah, the biblical story of the binding of Isaac; the virtue of forgiveness. One of the book's highlights is its literary approach to theology that at the same time makes room for philosophical exploration of religion. Another is Wettstein's rejection of the usual picture that sees religious life as sitting atop a distinctive metaphysical foundation, one that stands in need of epistemological justification. A special report of The Hastings Center and the Association of American Medical Colleges addressed the ethical oversight of learning health systems, which seek to combine high‐quality patient care with routine data collection aimed at improving patient outcomes. The report contained two position papers, authored by a number of distinguished bioethicists, and several commentaries. The position papers urged two changes. First, they urged a rethinking of our approach to the regulation of human subjects research, so as to make it easier (...) in the future for learning health systems to function well. Second, they argued that the rethinking required dispensing with a strict distinction between research and therapy, which has been a major tenet of bioethics since the Belmont Report, which explicated basic ethical principles governing human subjects research. We fully support the objectives of the authors, and we agree that the learning health system is an important advance that serves patients well. Unnecessary regulatory burden ought not impede this progress. We disagree, however, that the best way to bring about these needed changes in the regulatory environment is to reject the basic distinction between research and treatment. Unfortunately, we find the arguments in favor of that strategy to be, in places, reminiscent of what we take to be basic conceptual errors that hampered the ethical understanding of human subjects research prior to adoption of the Belmont Report. To see why one need not reject the research‐treatment distinction in order to promote learning health systems, we first investigate in some detail the arguments offered for eliminating the distinction. We next turn to an issue not addressed by those authors, namely, the relationship between the physician or investigator and the patient or subject, to illustrate why the distinction is important and what is lost if it is jettisoned. Although the physician’s use and misuse of power have been discussed in the social sciences and in literature, they have never been explored in medical ethics until now. In this book, Dr. Howard Brody argues that the central task is not to reduce the physician’s power, as others have suggested, but to develop guidelines for its use, so that the doctor shares with the patient both information and the responsibility for deciding on appropriate treatment. Dr. Brody first reviews literary (...) works dealing with medical power, from Dostoevsky’s “The Grand Inquisitor” to stories by William Carlos Williams, Vonda McIntyre, and Richard Selzer. These works, he shows, reveal the healers’ ambivalence over their own powers and patients’ fears of the abuse of power. Dr. Brody then points out important but neglected ethical issues that emerge from an analysis of power, such as the tension between care of individual patients and the pressures of the doctor’s workload; the rescue fantasy that impels some physicians to extraordinary lengths to save a life; and the economic system, which rewards surgeons and other specialists more than it does physicians who spend time talking with patients about their problems. He also shows how the perspective of shared power can shed new light on standard topics in medical ethics—from informed consent and confidentiality to resource allocation and cost containment. In 1945–46, representatives of the U.S. government made similar discoveries in both Germany and Japan, unearthing evidence of unethical experiments on human beings that could be viewed as war crimes. The outcomes in the two defeated nations, however, were strikingly different. In Germany, the United States, influenced by the Canadian physician John Thompson, played a key role in bringing Nazi physicians to trial and publicizing their misdeeds. In Japan, the United States played an equally key role in concealing information about (...) the biological warfare experiments and in securing immunity from prosecution for the perpetrators. Recently, there has been an upsurge of attention focused on bias and its impact on specialized artificial intelligence applications. Allegations of racism and sexism have permeated the conversation as stories surface about search engines delivering job postings for well-paying technical jobs to men and not women, or providing arrest mugshots when keywords such as “black teenagers” are entered. Learning algorithms are evolving; they are often created from parsing through large datasets of online information while having truth labels bestowed on them (...) by crowd-sourced masses. These specialized AI algorithms have been liberated from the minds of researchers and startups, and released onto the public. Yet intelligent though they may be, these algorithms maintain some of the same biases that permeate society. They find patterns within datasets that reflect implicit biases and, in so doing, emphasize and reinforce these biases as global truth. This paper describes specific examples of how bias has infused itself into current AI and robotic systems, and how it may affect the future design of such systems. More specifically, we draw attention to how bias may affect the functioning of a robot peacekeeper, a self-driving car, and a medical robot. We conclude with an overview of measures that could be taken to mitigate or halt bias from permeating robotic technology. (shrink)

Most accounts of why physicians have a duty to treat patients during a pandemic look to the special ethical standards of the medical profession. An adequate account must be deeper and broader: it must set the professional duty alongside other individual commitments and broader social values.

Agnes's brakes fail. Should she continue straight into the busy intersection or should she swerve into the field? Add to the story, what Agnes does not and cannot know, that continuing into the intersection will cause no harm, whereas swerving into the apparently empty field will cause a death. I evaluate arguments for the claim that she should enter the intersection, i.e. for objectivism about right and wrong; and arguments for the claim that she should swerve, i.e. for subjectivism about (...) right and wrong, and conclude that subjectivism is more plausible. I also consider the view that ‘ought’ and ‘wrong’ are systematically ambiguous, that she subjectively ought to swerve and that she objectively ought to enter the intersection. I argue that most versions of this suggestion are unworkable, and that even the best version is less plausible than pure subjectivism. (shrink)

Howard Kainz addresses several areas of Hegel's Phenomenology that are often overlooked in the interest of ensuring that readers do not "miss the trees for the forest." He argues that these "trees" are of interest in their own right, and keys to the ongoing appreciation of Hegel's work.

The main purpose of the article is to get clear what Leibniz's concerns about relations were. His: I do not believe that you will admit an accident that is in two subjects at the same time. My judgement about relations is that paternity in David is one thing, sonship in Solomon another, but that the relation common to both is a merely mental thing whose basis is the modifications of the individuals is best seen as akin to: Father is true (...) of David. Son is true of Solomon. But Being a father of is not true of any individual. Leibniz, like modern nominalist Nelson Goodman, could not allow the ordered pair . To establish this I must argue against Hidé Ishiguro's claim that Leibniz should have straightforwardly constructed a logic of relations, and Jaakko Hintikka's claim that Leibniz could have allowed the use of relational predicates in such forms as (Ex) Rax and (Ey) Ryb. I must also argue that what they say about the windowlessness doctrine (especially the as if formulation) is beside the point. (shrink)

Minogue's criticism of MacIntyre and Gorovitz's concept of medicine as a science of individuals is flawed by an assumption of the perfectibility of science that is not well supported by experience to date. More significantly, both Minogue and MacIntyre and Gorovitz have been led astray by choosing to use the malpractice issue as a philosophical point of departure for an inquiry into medical error. The problem of error in medicine, and moral culpability for error, is of great philosophical interest but (...) requires a more detailed contextual approach than these two studies provide. Family medicine has grown as a specialty from its early days of general practice. It was established as a Board Certified specialty in 1969. This growth and maturation can be traced in the philosophy of family medicine as articulated by Edmund D. Pellegrino, M.D. Long before it was popular to do so, Pellegrino supported the development of family medicine. In this essay I examine the development of Pellegrino's philosophical thought about family practice, and contrast it to other thinkers like Ian (...) McWhinney, Kerr White, Walter Spitzer, Donald Ransom, and Hebert Vandervoort. The arguments focus on whether the goals of family medicine and family practice (possibly two distinct entities) can be articulated, especially considering the definitional problems of family and community. I conclude by echoing Pellegrino's hope that family medicine can contribute a fresh alternative to isolated, individualistic and technological thinking in medicine. (shrink)

Published in 1981, “The Maximin Strategy in Modern Obstetrics” offered two claims—first, that obstetrical interventions ought to be assessed not singly, but rather as packages of interconnected measures that could cumulatively increase risks of harm; and second, that many of these interventions, considered either singly or as a package, lacked a sound evidence base. The first claim has been well supported by later literature, although the term “cascade effect” has proven a more felicitous descriptor for the phenomenon of interventions that (...) trigger the use of other interventions to monitor, prevent, or treat possible side-effects. The second claim was initially supported in a very inadequate way, since the “Maximin” article appeared before an understanding of the methods of systematic reviews of medical evidence had been widely promulgated. Despite these defects, subsequent, rigorously conducted systematic reviews have tended to confirm the impression first offered in 1981, that practices that support physiologic childbearing and the innate, hormonally driven capacities of childbearing women and their fetuses/newborns are much more in keeping with the available evidence than practices involving common or routine high-technology interference with physiologic processes. Harm may occur either directly, through high-technology interventions, or when such procedures distract attention and resources from safe, effective biological processes and lower-technology measures. Surveys indicate a lack of knowledge of this evidence among childbearing women, signaling a serious ethical deficiency in shared decision-making processes and perhaps the skills and knowledge of maternity care clinicians. Zhu Xi’s 朱熹 interpretations systematized the Five Classics; moreover, he elevated the “Four Books” to such a supra-canonical status that these texts along with his commentaries became the core curriculum for civil service examinations from the early 13th century to the 20th century. Inquiring into what was the essential and unique Song 宋 character of Classical scholarship, we will highlight the canonical Ritual Classics because these texts were crucial for centuries, especially during the Han 漢 through Tang 唐 dynasties. We (...) show how Zhu updated ritual practices by focusing on the Yili 儀禮 as the crucial Classic for guidelines on etiquette, and also rebalanced the relation between rituals and moral “principles.” We will explore how Zhu’s systematization of moral principles and ritual did not fully resolve tensions from his major 11th-century philosophical predecessors regarding principles and ritual, as well as the Four Books and the Five Classics. Even if Dai Zhen’s 戴震 criticism of Zhu was somewhat misplaced or overstated, tensions within Zhu’s views provide us a basis for understanding Dai’s attacks and ambivalence among Qing 清 and 20th-century scholars toward Zhu Xi’s philosophy. “The Pearl of Great Price” is a short story that explores the ways faith can go wrong. The central character, Janet, a single mom in a dead end job, is drawn into a multi-level marketing scheme, Benevite, by an unscrupulous salesman. She is encouraged to believe in herself and her dream and to give everything she has to it. She is fed the standard clichés to the effect that you can achieve whatever you want if you try hard enough. In (...) the end her faith in her dream leads to the loss of her relationship with her child and other losses. Her pursuit exhibits many of the standard features of faith, belief, desire, resilience, tenacity, passion, and yet she does not save herself. The story is not meant as an indictment of faith in general, but as an acknowledgement of the fact that faith can be a vice and an exploration of when this might be so. (shrink)

The article is a detailed case study of theft and fraud by an employee in an organization. The analysis suggests that in the process of dealing with the employee, the issue was notprimarily one of ethics, but of two moral principles in conflict, compassion and concern for a fellow human being and the morality governing responses to betrayal. The latter governed the results because that morality was congruent with the predominant ethics of the organization concerned with preserving the authority structure (...) and integrity of the organization rather than the personal welfare of the individual in the organization. In sum, the paper argues that, based on this case, organizational behavior towards individual employees may be determined by individual morality that is reinforced by organizational ethical principles more concerned with the self interest of the organization than ethics per se. Is education being disingenuous about arts education? When arts education is evaluated, the value of arts education is disputed. Arts education is judged to be of poor educational proof value. I believe a very different conclusion about arts education can be drawn. Pertinent to a good education in general is arts education.
